The fact that his wife is apparently recanting or offering support for his application to have the conviction expunged ordinarily would not require the judge to do anything, unless there's something in California law that requires a judge to do so if, for example, the defendant needs it to find gainful employment. Interesting, but I'd imagine the judge would take it into account at least, specifically in terms of the fact that the conviction on his record would hurt both him and his wife.
