sammyk
I don't think so, but there is also no guardrail between the platform and the tracks. If somebody wanted to get onto the tracks, they wouldn't need to access the stairs to do so. Edited July 19, 2007 by sammyk
devilsfan26
Well, if they put a guardrail there you can't get exactly get on the train. Perhaps they want to restrict access there for safety reasons so people don't wander off down there and put themselves in danger from the train. On the platform there are lines that you aren't supposed to cross, those are likely no there at track level. There could also be things under the platform they don't want people going near. There could be high voltage electrical equipment there that could be dangerous. Is this the area in question?
RowdyFan42
Could it be there by going down those stairs you may have had easy access to the tracks? And THAT would be a valid reason for restricting access to the area, and I believe I even said as much earlier in the discussion. It's not so much the going over the gate part or the being on the stairs part that got him in trouble, it was being on the grass. The diagram clears it up somewhat; specifically, the guardrail turns the grass into a completely enclosed area, although it's entirely possible that the guardrail is there moreso for traffic control than pedestrian control. It becomes clearer to see how the charge of trespassing can stick, though I continue to believe that the expected punishment is still far too severe. Hopefully the OP can work out a deal to reduce the charge or at least the penalty.
sammyk
Yea I know it's not practical to put a guardrail on the platform, but my point is if someone wanted to get there, there is nothing stopping them, including the gate.
devilsfan26
See, you're looking at it from a security point of view. It may have to do with safety. What if kids wander off the platform? They may know not to jump off the platform but if they see stairs they may go down there.

And yea that's a better picture of the area than mine

devilsfan26
I tried but I can't get my scanner to work. It said I needed to uninstall it so I can reinstall that feature or whatever, so I uninstalled it, and when I try to reinstall it, it never finishes. happoloti
Hey man, your post really caught my attention as I was doing some research. I'm not really a hockey fan and I registered just to reply to this post because I just had a very similar experience that you did. I too received a summons for Defiant Trespassing at Metropark. I went through a space between the railing and the wood partition and jumped down on to the grass next to Rte. 27 at the opposite end that you did. My court date is in a month and I'm really anxious out about this. I'm a few years older than you and just graduated from Rutgers. I was wondering if you could discuss your experience and final outcome with me. I would really value your hindsight. Please e-mail me if you can. happoloti@hotmail.com Mark Edited November 8, 2007 by happoloti

point
Make your court appearance and !) Hope the trooper doesn't show up to testify, and this is VERY IMPORTANT 2) talk to the municipal prosecutor before court is begun to get the charges reduced to loitering or something far less than trespass. If you are respectful, don't have any priors, he/she will work with you. this is advise from a friend is is a former prosecutor and current municipal judge.
