NHL 09 Custom Music

So MB gave me an idea of assembling a pack of music for the in-game music. I'll be editing the songs and re-verbing them so it sounds like a song being played in an arena. I'm not really sure if it is exactly LEGAL for me to do this? Technically it isn't any full songs, but if it isn't, then any mods can feel free to warn me/delete this thread.

SO FAR I HAVE:

Custom realistic Devils intro I made.

Custom realistic Devils goal horn/RRP2 combo I made.

WILL BE MAKING:

SONGS:

1.Big Casino by Jimmy Eat World ("I'm a New Jersey success story")

2.Timebomb by Beck

3.Tick Tick Boom by The Hives

4.Hate To Say I Told You So by The Hives

5.I Wanna Rock by Twisted Sister

6.Start Me Up by Rolling Stones

7.Tarantula by Smashing Pumpkins

8. "Kenkraft 400" -Zombie Nation

9. "Born to run" - Bruce

10. "Glory Days" - Bruce

11. "Enter Sandman" - Metallica

12. "Welcome to the Jungle"- Guns N' Roses

13. "Rock and Roll All Nite" - KISS

14. "Elevation" U2

15. "We're not gonna' take it" Twisted sister

16. "The Middle" - Jimmy Eat World

17. "Firestarter" - Prodigy (beginning of 3rd period)

18. "Smells Like Teen Spirit"

Holy sh!t thats long. And what you can do to make it legal (i think) is plug your ipod into your xbox w/ your usb cable and see if you can upload the music to your xbox. idk if you can upload music from an ipod directly though, ive only played music from my ipod

edit: didnt read the full thing, lol. idk if editing them is legal or not, though my friend who is a dj doesnt get in trouble for sampling music.

The only way I know of to get your music onto your 360 is to burn it to a CD then rip them from the CD to your Xbox. Then you can customize your music for NHL09 from that.

yeah once I upload the ZIP file I'll have step-by-step instructions for burning, ripping and sh!t.

edit: HAHA just saw this:

I don't see why it wouldn't be legal to edit the songs. After all, you wouldn't want to import the entire song into the game, you'd only want clips. The whole point of the import music functionality, I thought, was to let you bring in whatever you want.

The legality of distributing this ZIP file, though, is a little murky. I think it's okay, though, since AFAIK there are sites dedicated to the EA NHL series where you can download other people's song mixes and goal horns.

Alright, then we're in buisness. I'm actually 1/3 done with the music. Should have a Zip up by tomorrow night.

Are you gonna put the link up on the forums? I would love to have all those songs for my NHL 09 game.

Well, I finished the first edition of the New Jersey Devils song pack for NHL 09!

RWTD's New Jersey Devils Custom Music Vol. 1.zip

The folder contains all of the songs from the list above, the goal horn/song, a standalone goal song, the current intro, and my epic intro that some of you may remember from last year.

IF YOU WANT THIS ON YOUR XBOX 360 FOR IN-GAME USE!

On your computer:

1. Take the ZIP and extract it.

2. Add everything to your burn list on WMP.

3. Burn to a CD.

Xbox-360

1. Press the eject button on your Xbox, enter the CD into the Xbox.

2. Once the CD loads, it will most likely begin playing a random song from the CD. Press the

I think you need to make EVERY song a playlist, no? I dunno why but they go by playlists on Xbox instead of the songs on Xbox, which kinda sucks because that means you have make each on a playlist.

yeah thats what i mean. in the ZIP i seperated all the "Break in play" songs from the intros and stuff. On my xbox I threw all of those songs together in a playlist, did a seperate playlist for the intro, seperate for the goal song, seperate for the end of game. You need to make a LOT of playlists. I called mine NJDBREAK (for break in play) NJDGOAL, NJDEND (of game) , NJD INTRO.

edit: also can anyone give me a better file hosting site?

The ONLY time it is illegal to do something with copyrighted anything is when you profit from it. You can edit whatever music you wish and make it available to people just so long as you are not profiting from it.

The gray area to making it available on the internet is the site you download it from makes money off of its web ads which in turn can be tied to making a profit off the music since technically it is the music bringing the person to that page to download it and webmasters get paid usually per hit on thier sites.

Worst case scenario is the file is removed from the site.

Sorry to bust everyone's bubble but that's not 100% accurate. What Running is doing, while kick a$$ in it's own right, is technically not legal.

The problem is he's making the copyrighted material available for anyone to download. Fair Use dictates you can do whatever you want to copyrighted material you purchase...make a mix tape for your car, mash up a song in a remix, play for a friend, etc...as long as it's for you and only you. The minute you make that material available for others, it's copyright infringement.

Also, a common misconception is to claim Fair Use if you're not making money from the distribution. Problem with that is, by making copyrighted music free to the public, you're taking money out of the owner's pockets. Why buy it when you can get it for free?

As for DJing and public performance, like someone else mentioned in this thread, it's technically not legal to "broadcast" music in a public forum but that isn't really enforced by record companies since you can't take a party home with you. Think of it like the "This broadcast of the NFL is prohibited for redistribution..." message before any sporting event. Bascially, the bars are breaking the law by playing it but nobody really cares. So, your friend can feel free to re-mix and play music at parties as much as he wants.

One last thing...if Runnin' took small snipets of the songs in question and made an "In Game Mix" available to the world, that would be waaay more legal than using the whole song. Fair Use dictates you can use snipets of copyrighted media, which legalizes most hip hop samples, reviews and ::ahem:: message board news threads. If a record company took you to court, you would probably still lose, but you would have more of a case.

All that being said, thegame is right when he says the worst that will happen is they remove the .zip from their server. Also, I can't dl the zip from work, so I'm not sure if you used full songs or not...if you didn't, then disregard my ramblings!

Edit : Just reread the thread and Runnin' did mention he was taking clips, which is definately "more legal" than jacking the whole song. I believe the law is somewhere around 15 seconds but I'll have to look that up. My whole point of this post was the whole "If you're not profiting, it's cool" vibe...that is most certainly not the case.

I guess I was off. All that you mentioned doesn't surprise me given the fvcked up state of our copyright laws in the US.

I tried to bring a bunch of songs onto my Xbox for use in NHL 09 a few months ago, and I spent hours organizing the music into playlists, etc. However when I tried playing a game with the music, it played so low I couldn't even hear it. Break in play music could barely be heard, and home goal music wasn't even audible period.

That happned to me too. I gave up on it and just created a network between my computer and my Xbox so now I can stream music files directly from my HD. Its eaiser then going through all the playlist stuff and the music is so low you need to silence the crowd and comentary. You just dont get the effect of getting different music when play stops etc. The only song i kept on the playlist was when a goal is scored they play the hey song at home but you can barely hear it. =p
